Contest Terms and Conditions
1. NO PURCHASE NECESSARY TO ENTER OR WIN
2. HOW TO ENTER:
Beginning on the designated start date and ending on the designated end date, follow all posted entry instructions. Use of any robotic, automatic, programmed, or similar entry methods, or entering more than the number of times permitted will void all entries and result in disqualification. Using multiple email addresses, identities, or devices in an attempt to circumvent the rules and enter multiple times will also invalidate all entries and result in disqualification.
3. ELIGIBILITY:
Open to United States residents 21 years of age and older on the date of their redemption, except for employees of The Commerce Casino and Hotel (“The Commerce”). Void where prohibited.
4. DRAWING:
4.1. A random drawing will be conducted on the designated date and time by Commerce. The winner(s) will be selected from among all eligible, valid entries received. Odds of winning depend on the number of entries received. Winner(s) will be notified by email/phone/social media platforms. By entering the promotion, the entrant accepts and agrees to these Official Rules and the decision of The Commerce, which shall be final in all matters.
4.2. For non-random contests, winners will be chosen based on various factors including but not limited to creativity, originality, and adherence to the theme of the contest. Winners will be chosen at the discretion of the organizers based on subjective criteria as stated in the contest submission rules.
5. REDEMPTION:
Winners are required to redeem their prize at The Commerce Casino and Hotel. Any transfers are subject to approval by Commerce in its sole and absolute discretion. If the winner is found to be self-excluded or barred from entering The Commerce, their entry and selection will be deemed null and void and the prize will not be eligible for transfer. Winners must promptly respond to The Commerce and confirm their acceptance of the prize within the applicable time period. Failure to respond within the applicable time period will result in forfeiture of the prize, and The Commerce reserves the right to award it to an alternate winner. Upon request, winners must provide their name, biographical information, email address, phone number, and social media information, to The Commerce to facilitate prize fulfillment. Failure to do so may void the prize. By accepting a prize, winners grant permission to The Commerce to use their name, biographical information, email address, phone number, and social media information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.
6. PRIZES:
Prizes are non-negotiable and non-refundable. In the event that a Prize becomes unavailable for any reason, The Commerce reserves the right to substitute a prize of equal or higher value in the sole and absolute discretion of The Commerce. Entrants may be eligible to win specific contests multiple times at the discretion of The Commerce; however, eligibility to win certain contests may be limited to once per person, as determined by The Commerce in its sole discretion.
7. SOCIAL MEDIA:
The winner’s name and social media username(s) may be posted on the social media accounts of The Commerce after the winner has been selected.
8. LIMITATION OF LIABILITY:
By entering this promotion, entrants waive all right to, and hold The Commerce harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this promotion or the acceptance, use, or misuse of any prize. The Commerce will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices for any reason including, but not limited to due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this sweepstakes; by any human error which may occur in the processing of the entries in this drawing; or any typographical, technological, or other error in the publishing of the offer, administration of the promotion, or announcement of the prize(s). If, in The Commerce’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the drawing, or if technical difficulties (including viruses and bugs) compromise the integrity of the drawing, The Commerce reserves the right to cancel or modify the drawing in a manner it deems appropriate. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.
9. UNFORESEEN CIRCUMSTANCES:
In the event of unforeseen circumstances beyond The Commerce’s reasonable control, the Commerce reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
10. CHOICE OF LAW AND FORUM:
Entrant agrees that all matters arising out of or relating to this drawing and these Official Rules are governed by, and construed in accordance with, the laws of California, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this drawing and these Official Rules shall be brought exclusively in the applicable federal or state courts located in Los Angeles, California.

12. HOTEL STAYS:
The specific dates for hotel room prizes are at the discretion of The Commerce and are subject to availability. The Commerce reserves the right to substitute hotel room stays for prizes of equal or greater value.
13. DISQUALIFICATION
If a contestant or winner is determined to have influenced the results in any manner considered to be in bad faith by The Commerce, their Prize is subject to removal. The Commerce reserves the right to withdraw prizes from contestants who engage in intimidation, harassment, ridicule, or any other inappropriate behavior towards The Commerce’s social media accounts or community.
